Terms of Use

GraffitAid ("the Platform") is operated by MAAST, a registered NGO in Goa, India. By accessing, browsing, or uploading any content to the Platform, you ("the User") agree to be bound by these Terms of Use. If you do not agree, you must not use the Platform.

1. Intermediary Status

GraffitAid functions as an intermediary under Section 79 of the Information Technology Act 2000 (as amended, including the Information Technology Act 2026 and Intermediary Guidelines and Digital Media Ethics Code Rules 2021). The Platform does not pre-screen, edit, or curate User-Generated Content ("UGC") before publication. All content displayed is automatically published by users themselves.

2. Prohibited Content

You agree NOT to upload, post, or transmit any content that:

  • Is defamatory, obscene, pornographic, paedophilic, or sexually explicit
  • Promotes hate speech, communal disharmony, or racial discrimination
  • Contains political propaganda, electioneering, or partisan campaigning
  • Glorifies violence, terrorism, or criminal acts
  • Infringes any patent, trademark, copyright, or other proprietary rights
  • Impersonates any person or entity
  • Is harmful to children in any manner
  • Violates any law in force in India

3. AI Content Moderation

GraffitAid employs automated content filters including OpenAI's omni-moderation API and proprietary toxicity classifiers on both bricks and user comments. Content flagged by these filters is automatically held for review or rejected. However, AI moderation is not infallible, and inappropriate content may occasionally appear. If you encounter such content, please use our Report a Brick page or the report button on individual comments to file a takedown request.

4. Takedown Procedure (Section 79 Compliance)

Upon receipt of a valid complaint via the Report a Brick page or via written notice to legal@graffitaid.com, GraffitAid will:

  • Acknowledge the complaint within 24 hours
  • Remove or disable access to the reported content within 36 hours of receipt of valid complaint or court/government order
  • Preserve content and access logs for at least 180 days for law enforcement
  • Cooperate fully with lawful requests from Indian law enforcement agencies

5. User Responsibility & Liability

The User is solely and entirely responsible for any content uploaded. By uploading content, the User represents and warrants that:

  • They own the content or have full rights and licenses to publish it
  • The content does not violate any law or third-party right
  • They will indemnify GraffitAid, MAAST, and its officers, agents, and partners against any claim arising from their content

6. Data Retention

As required by law, GraffitAid retains user-upload logs (IP address, timestamp, user identifier, content metadata) for a minimum of 180 days, even if the user deletes the underlying content.

7. Termination

GraffitAid reserves the right to suspend, ban, or terminate any account found violating these Terms, without prior notice and without refund of any contributions made.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Panaji, Goa.

10. Changes to Terms

GraffitAid may update these Terms at any time. Continued use of the Platform after such changes constitutes acceptance. Material changes will be notified to registered users via email and prominent notice on the Platform.
